TOS (TERMS OF SERVICE) – ARTISTIC DOT

PROCESS (CUSTOM ART)

Once it’s your turn on the queue, I will send you an invoice via paypal (wait for it). Payment is

expected in 48h. I will also send you the terms of service.

You will be informed about the progress during the entire process. Once the payment is confirmed I’ll start the comission.

 I’ll share the WIPS with you to approve (usually between 1-3 depending on the complexity/type of comission).  I’ll send the WIPs, and each step will

require your approval. Once it’s all finished and approved, I’ll send you the finished drawing full size (Usually in .png extension.)

PROCESS (YCH ART)

Once it’s your turn on the queue, I will send you an invoice via paypal (wait for it). Payment is expected in 48h. I will also send you the terms of service.

You will be informed about the progress during the entire process. Once the payment is confirmed I’ll start the comission.

 I won’t share WIPS with you, unless stated otherwise (example: Complex characters);

I’ll send thefinal product, and you can ask for edits 3 timesl. Once it’s all finished and approved, I’ll send you the finished drawing full size (Usually in .png extension.)

PAYMENT

-For comission payments, I’ll send you an invoice in Paypal or my Ko-fi page link.

-Payment is always full, upfront. Payment plans can be discussed, but only if you already commissioned me at least twice.

-I ask for the payment only when your I start working on slot BATCH, except in special cases of mutual agreement to pay in advance.

-Paypal & Ko-Fi only for USD payments.

-I retain the right to charge extra for complexity. In that case, I’ll discuss the prices with the

comissioner.

-New clothes creation for existing characters will be charged extra. In that case, I’ll discuss the prices with the comissioner.

REFUNDS

-No refunds will be given for completed/nearly completed commissions.

-Will be given full refund if the comission wasn’t started when the client asked to cancel it.

-For custom, if the client needs to cancel the comission during the process, each step gives partial refund:

-Sketch (70%)

-Lineart (40%)

-Flat colour / shading (0%)

-I reserve the right to cancel a commission at anytime, for any reason, and without explanation.

In that case, I’ll give full refund.

-I retain the right to resell canceled commissions.

-DON’T insist on asking me to draw anything on the disallowed list.

COPYRIGHT

-DO NOT  FEED MY ART TO AI. 

-I, the artist, retain full and exclusive rights to the original artwork. The client may not claim it as their own or use it for anything other than personal use.

-My signature (watermark) always have to be visible on the artwork. If removed, it will be counted as theft.

-You can repost the artwork as long as you credit me properly (provide a link for my social media, my watermark visible).

-You can’t edit my artwork in any way without asking for permission first, with the exception of cropping/resizing it to use as profile picture.

ABOUT WIPS/GENERAL WIP INFO

-The comissioner is responsible to provide me with clear and concise visual reference, descriptions and details (pose, expression, situation, etc) for the artwork on the briefing phase (before I start the sketch).

-The comissioner must be available on the preferable contact method to provide approvals for the WIPS.

-You can only share the WIPs with friends if they have my signature/watermark.

-You can ask for structural/pose changes ONLY on sketch phase. I won’t make them in any other phase.

-On lineart phase you can ONLY ask for small details as changes, IF it’s something that was on the character reference and I didn’t add it. Any big structural changes here will be charged extra.

-On colour phase, if it’s a new character design, the pallete will be decided in mutal agreement. If it’s a character that already exist, I will or won’t show a WIP, depending on the comission. Expect some colour variation (nothing drastic).

GENERAL

-I retain the right to refuse any comission, for any reason, and without explanation.

-Both parts (Artist and Comissioner) must be repectful when communicating with each other, during the entire process.

-I retain the right to have my own limits of artistic expression/style depicting the original design of the character. Character Design interpretation may not have 100% of accuracy.

-About pose/situation/expression, I will match the scene that you have in mind but expect variations in the result.

- If you don’t want me to post your comission or want your name/nickname to stay anonymous, tell me on briefing phase (when you order and send me details about the comission).
